What happens after you file

Each step usually happens in the order below. Most domestic-abuse cases reach a full hearing within 15 days.

    Judge reviews your petition (same day)
    A judge reads what you wrote and decides whether to grant a Temporary Restraining Order right away (ex parte).
  2. 2
    Ex parte TRO issued (if granted)
    If the judge grants the TRO, it goes into effect immediately and lasts until your full hearing.
  3. 3
    The other person is served
    Law enforcement or a process server delivers the TRO to the other person. The order does not take effect against them until they are served.
  4. 4
    Full hearing (within 15 days)
    Both sides come to court. You can bring a support person, witnesses, and evidence. The judge decides whether to grant a longer order.
  5. 5
    Long-term order (if granted)
    The longer order can last up to 3 years for harassment or stalking, and longer for domestic abuse.
